TERMS AND CONDITIONS (T&C)

1. Provider and Scope

These Terms and Conditions (“Terms”) govern the use of the NEXT Companio platform (“Platform”) by all users.

The Platform enables the worldwide connection of caregivers (“Caregivers”) with individuals or organizations seeking care services (“Employers”).

By registering for the Platform, users agree to these Terms.

2. Description of Services

The Platform provides:

Creation of Caregiver and Employer profiles
Search and matching of care services
Communication between registered users
Access to Platform features for registered members

The Provider does not guarantee successful placement or employment.

3. Registration and User Accounts

3.1 General

Users must register to access the Platform.

Users agree to:

provide complete and accurate information;
keep their information up to date;
maintain only one account per person.

The Provider reserves the right to suspend duplicate or fraudulent accounts.

3.2 Caregiver Registration

Caregivers must provide:

Full name
Email address
Password
National ID number (mandatory)

Additionally:

Select at least three offered services
Optional profile description (maximum 500 words)
Upload one to three profile images (optional)
Upload a résumé/CV (optional)

The Provider may review and verify submitted information.

3.3 Employer Registration

Employers must provide:

Name or Company Name
Email address
Password

Additionally:

Select at least three required care services.

4. Membership and Payments

4.1 Membership

Access to the Platform requires an active membership.

Membership fee: EUR 29

Important: Choose one billing model and keep it consistent:

Option A (Recommended):

EUR 29 per month
Automatically renewed monthly

Option B:

EUR 29 per year
Valid for 12 months
Automatically renewed annually

4.2 Payment

Payment must be made in advance.

Accepted payment methods include:

Credit Card
PayPal

Membership becomes active after successful payment.

4.3 Automatic Renewal

Membership automatically renews unless cancelled before the end of the current billing period.

4.4 Failed Payments

If payment cannot be processed, the Provider may:

restrict access to Platform features;
suspend the user’s profile until payment is received.

4.5 Grace Period

After membership expires, users may have limited access to certain Platform functions, including messaging and contacting other users.

5. User Obligations

Users agree to:

provide truthful information;
comply with applicable laws;
refrain from uploading unlawful or offensive content;
avoid discriminatory, fraudulent or abusive conduct;
use the Platform responsibly.

6. Termination and Account Deletion

6.1 Cancellation by Users

Users may cancel their membership at any time.

Cancellation becomes effective at the end of the current billing period.

6.2 Termination by the Provider

The Provider may suspend or permanently terminate accounts for:

false information;
violation of these Terms;
fraudulent or abusive use of the Platform.

6.3 Account Deletion

Users may request deletion of their accounts.

Personal data will be deleted in accordance with applicable legal requirements, including the GDPR where applicable.

7. Caregiver Verification

To improve trust and quality, Caregivers must provide:

Verification by the Provider does not constitute a guarantee regarding identity, qualifications or reliability.

8. Intellectual Property

All Platform content, software, trademarks and materials are protected by intellectual property laws.

Users may use Platform content solely for personal, non-commercial purposes.

User-generated content remains the responsibility of the respective user.

9. Limitation of Liability

The Provider is liable only in cases of:

intentional misconduct; or
gross negligence.

To the extent permitted by law, liability for slight negligence is limited.

The Provider is not liable for:

successful placements;
conduct of users;
quality of care services;
external events beyond its control.

10. Platform Availability

The Provider aims to maintain continuous Platform availability but does not guarantee uninterrupted service.

Maintenance, updates and technical interruptions may occur.

11. Privacy and Data Processing

11.1 Personal Data

Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy laws.

11.2 Purpose of Data Processing

Personal data may be used for:

matching Caregivers and Employers;
communication between users;
improving Platform services;
customer support.

11.3 Data Storage

Personal information is stored securely using appropriate technical and organizational measures.

11.4 Data Sharing

Personal information will not be shared with third parties without user consent, except where required by law.

11.5 Public Profiles

By registering, users consent to displaying the information included in their public profile on the Platform.

12. IT Security

The Provider implements appropriate security measures including:

SSL encryption;
access controls;
secure server infrastructure;
regular security monitoring.

13. Amendments

The Provider may update these Terms from time to time.

Users will be informed of significant changes.

Continued use of the Platform constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by the laws of the Federal Republic of Germany.

Where legally permissible, the place of jurisdiction shall be Frankfurt am Main, Germany.

If any provision is found to be invalid, the remaining provisions shall remain in full force and effect.

DISCLAIMER

No Guarantee of Placement

The Platform merely facilitates contact between Caregivers and Employers.

The Provider does not guarantee:

successful employment or placement;
the quality of care services;
the conduct or reliability of users.

User Responsibility

Any employment or service agreement is concluded solely between the respective users.

The Provider is not a party to such agreements.

Content Accuracy

The Provider makes no warranties regarding the accuracy, completeness or timeliness of user-generated content.

External Links

The Provider accepts no responsibility for the content of third-party websites linked from the Platform.

Use at Your Own Risk

Users access and use the Platform entirely at their own risk.
